The Management and staff of Cape St Francis Resort /Beach Break, are committed to ensure a relaxing and peaceful holiday to our guests.

We therefore ask our guests to comply with these terms and conditions:

1. In the event of a cancellation of a booking the following cancellation policy will apply:   
   Cancellation prior to 56 days will incur an administration fee of 10% of the deposit value 
   56 to 28 days prior to arrival , forfeit 25 % of total accommodation value
   28 to 14 days prior to arrival , forfeit 50% of total accommodation value
   14 to 7 days prior to arrival , forfeit 75% of total accommodation value
   Less than 7 days prior to arrival , forfeit 100% of total accommodation value.  
   
   
2. The maximum occupancy of the room/unit may not exceed the maximum numbers stated on the Confirmation of  Reservation.
   
   
3. A copy of the inventory is in the room/unit. We ask our guests to check the inventory provided and report any discrepancies  to Reception by the next day , otherwise guests will be held liable for any damages or losses in the room/unit . Your honesty and integrity is appreciated in this regard. Once all conditions are met your breakage pre authorization will be released after your departure. In the event that damage or loss exceeds the breakage retainer you hereby irrevocably consent to the additional deduction of same from your credit card , the details of which you have supplied and warrant to be true and correct. In the absence of credit card details you will be held liable for any additional costs.
   
   
4. Cape St Francis Resort / Beach Break reserves the right to alter or amend rates and rate periods at any time.
   
   
5. Our check –in time is 14h00 and our check out is 10h00. We are able to provide change room and luggage storage facilities if required which are subject to availability.
   
   
6. Personal cheques are not accepted.
   
   
7. Rates are quoted in South African Rand and are inclusive of Value Added Tax at 14% and exclude a tourism levy of 1% of the accommodation charge.
   
   
8. Malherbe Resort CC , Beach Break  (The Proprietors) , their agents or employees shall not be held liable for personal injury, death or loss/theft/damage to property that may occur during the guest’s stay , on or about the Proprietors premises . The guest/s hereby waive/s and abandon/s any claims of whatsoever nature including but not limited to that theft, injury, death, loss or damage of whatsoever nature, against the Proprietors , whether arising from the Proprietors, their agents or employees  default, negligence or otherwise.
   
   
9. The guest/s  agree/s  to waive all rights to compensation, in respect of injury to persons or loss of or damage to property which may occur whilst on or about the Proprietors premises and agree/s to indemnify the Proprietors their agents or employees  in respect of all claims for personal injury or loss of or damage to property which may occur during their stay on or about the Proprietors premises.
   
   Malherbe Resort cc and Beach Break  (and its subsidiary sites) believes strongly in protecting the privacy of users of its web site.  There may be times when you will register for services  you may be required to provide Malherbe Resort cc  with personal information including, but not limited to, the following:
   
    your name
   e-mail address
   
   Malherbe Resort cc and Beach Break  will not sell to any third party your name, address, e-mail address and member name, unless you provide your informed consent, except to the extent necessary to comply with applicable laws, police investigations, or in legal proceedings where such information is relevant.  
   
   Your informed consent shall be in the form of an “opt in” or similar policy.
